New Kings of Roadside, LLC (NKR) publishes a listing-service website that lists publicly on its website the names of parties who publicly offer to provide roadside-assistance service. This document refers to such a party as a “Neighborhood Service Provider™” (NSP.)
Before you use the NKR website, you must agree, as a condition of using the website, that you are responsible for investigating the listed NSP prior to entering into a transaction with the NSP. You must agree that the NKR is not responsible for investigating the NSP.
You understand and agree that the NSP is the sole source of the information contained in the NSP’s listing and that the NSP is solely responsible for that information. You must agree that you do not hold NKR responsible for the information contained in the NSP’s listing.
The service NKR provides is limited to publishing on its listing-service website information supplied by NSP’s. NKR does not provide any other service.
NKR is not a party to any transaction between you and any NSP listed on the NKR website.
NKR does not charge per-transaction fees to the NSP. All amounts paid by a NSP to NKR, are not related to your transaction.
When you enter a transaction with a NSP, the policies of the NSP will govern your transaction. When a NSP elects to adopt some or all of the policy guidelines published by NKR on the NKR listing-service website, any such policy becomes the policy of the NSP. By using the NKR website, you are agreeing that there is no policy of NKR that governs any transaction between you and any NSP.
Covenant Not To Sue
By using the NKR website, you are waiving (giving up) your right to sue NKR. By using the NKR website, you are agreeing to hold harmless NKR against any and all damages and/or injury arising out of your contact with NKR and with any NSP listed on the NKR listing-service website.
Severability
The terms of this agreement are independent of each another. If any term in the agreement is deemed unenforceable by a court, the agreement as a whole will not be deemed unenforceable.
